The governor of California, Arnold Schwarzenegger, signed a law yesterday that will protect American journalist and broadcasters from British and foreign libel judgments and the court rulings of other.

The new legislation effectively negates the practice of libel tourism.

It represents the growing opposition among Americans to Britain’s libel laws, which are in conflict with the First Amendment of the US Constitution, which protects freedom of speech.

The law gives California courts the power to block libel judgments from Britain and Canada which, the state’s Senate Rules Committee say, have “become the jurisdictional Mecca and Medina for the rich and famous”.

The Committee adds its new law would “diminish the chilling impact of libel tourism on aggressive reporting about important international issues.”

The California law echoes one enacted by the state of New York in March 2008, called the libel terrorism protection act, which is the direct result of the Rachel Ehrenfeld controversy.

Dr. Ehrenfeld was sued in London by a Saudi Arabian businessman over her 2003 book on terrorist financing, Funding Evil, which alleged that the man and his family had provided financial support to Islamic terrorist groups.

Though her book was not published in Britain, some 20 copies had been purchased through UK-registered websites and several excerpts had been published online.

Dr. Ehrenfeld, who chose not to defend the action, was criticized by British judge, Justice David Eady, who ruled that she must pay £10,000 to each plaintiff plus costs; apologize for her false allegations; and destroy all existing copies of her book.

The decision outraged many American politicians, journalists and lawyers who believe the British courts are inhibiting freedom of expression.

Dr.Ehrenfeld has also turned into a campaigner on the issue. She wrote an article last week in protest against the plight of Paul L. Williams and Canada’s libel laws.

Dr. Williams is being tried in Canada for statements he made concerning jihadi activity at McMaster University. The suit, he contends, has stripped him of his professional career and has left him financially destitute.

Two other states – - Illinois and Florida – - have enacted legislation to shield people from libel judgments made outside America.

There is also a proposal to create a federal US law, the Free Speech Protection Act, to bar American courts from enforcing libel judgments issued in foreign courts against US residents if the speech/editorial content would not be considered libelous under American law.

The Daily Mail (London) in an editorial that appeared yesterday refers to London as “the libel capital of the world”. It concludes: “Doesn’t it shame us that one American state after another… has found it necessary to pass laws protecting its citizens’ freedom of expression from the book-burning rulings of the British courts?”

In our vibrant American Democracy every citizen has the right to his personal beliefs.

Americans, private citizens, and political figures alike, are free to choose their friends and enemies according to their world-view or personal agenda. These rights have served the nation well since the founding of the Republic and must be respected.

However, it is critical that the beliefs and personal/political agendas of our elected officials be clearly defined and made known to those who have placed them in positions of power. It is unreasonable to allow our lawmakers to misrepresent themselves to the electorate and once in office, use their authority to advance hidden agendas and policies that run contrary to the needs and expectations of the electorate.

‘Eternal vigilance is the price of freedom.” We have heard that many times. What is also the price of freedom is the toleration of imperfections. If everything that is wrong with the world becomes a reason to turn more power over to some political savior, then freedom is going to erode away, while we are mindlessly repeating the catchwords of the hour, whether “change,” “universal health care,” or “social justice.”

If we can be so easily stampeded by rhetoric that neither the public nor Congress bothers to read (much less analyze) bills that make massive changes in medical care, then do not be surprised when life-and-death decisions about you or your family are taken out of your hands — and out of the hands of your doctor — and transferred to bureaucrats in Washington.

Let’s go back to square one. The universe was not made to our specifications. Nor were human beings. So there is nothing surprising in the fact that we are dissatisfied with many things at many times. The big question is whether we are prepared to follow any politician who claims to be able to “solve” our “problem.”

If we are, then there will be a never ending series of “solutions,” each causing new problems calling for still more “solutions.” That way lies a never-ending quest, costing ever increasing amounts of taxpayers money and — more important — ever greater losses of your freedom to live your own life as you see fit, rather than as presumptuous elites dictate.

Ultimately, our choice is to give up Utopian quests or give up our freedom. This has been recognized for centuries by some, but many others have not yet faced that reality, even today. If you think government should “do something” about anything that ticks you off, or anything you want and don’t have, then you have made your choice between Utopia and freedom.

Back in the 18th century, Edmund Burke said, “It is no inconsiderable part of wisdom, to know much of an evil ought to be tolerated” and “I must bear with infirmities until they fester into crimes.”

But today’s crusading zealots are not about to tolerate evils or infirmities. If insurance companies are not behaving the way some people think they should, then their answer is to set up a government bureaucracy to either control insurance companies or replace them.

If doctors, hospitals, or pharmaceutical companies charge more than some people feel like paying, then the answer is price controls. The actual track record of politicians, government bureaucracies, or price controls is of no interest to those who think this way.

Politicians are already one of the main reasons why medical insurance is so expensive. Insurance is designed to cover risks but politicians are in the business of distributing largesse. Nothing is easier for politicians than to mandate things that insurance companies must cover, without the slightest regard for how such additional coverage will raise the cost of insurance.

If insurance covered only those things that most people are most concerned about — the high cost of a major medical expense — the price would be much lower than it is today, with politicians having piled on mandate after mandate.

Since insurance covers risks, there is no reason for it to cover annual checkups, because it is known in advance that annual checkups occur once a year. Automobile insurance does not cover oil changes, much less the purchase of gasoline, since these are regular recurrences, not risks.

But politicians in the business of distributing largesse — especially with someone else’s money — cannot resist the temptation to pass laws adding things to insurance coverage. Many of those who are pushing for more government involvement in medical care are already talking about extending insurance coverage to “mental health” — which is to say, giving shrinks and hypochondriacs a blank check drawn on the federal treasury.

There are still some voices of sanity today, who echo what Edmund Burke said long ago. “The study of human institutions is always a search for the most tolerable imperfections,” observes Prof. Richard Epstein of the University of Chicago. If you cannot tolerate imperfections, be prepared to kiss your freedom goodbye.

It’s payback time for white America.

“America’s Palestinians” are on the march, chanting “Ahora es la tiempo por audacia”!

Thousands of Latinos are gathering this Independence Day to celebrate the Farce of July.

This annual all-day concert and street fair is held on Cesar Chavez Avenue in East Los Angeles – - the heart of the barrio.

The event is sponsored by the Aztlan Underground to uphold the claim that the Southwest portion of the United States had been stolen from Mexicans and Mexican Americans by Yankee colonialists under the leadership of U.S. President James K. Polk.

Members of the Aztlan Movement and La Raza (of which Supreme Council nominee Sotomayor is a national director) seek to annex California, Arizona, New Mexico, Texas, and southern Colorado into a new nation: Republica del Norte, “the Republic of the North.”

Sounds like a far-fetched idea save for the fact that the 56% of Mexicans and Mexican Americans, according to a Zogby poll, favor the reconquista.

The creation of a “Hispanic Homeland,” Charles Truxillo, professor, University of New Mexico, maintains, is “an inevitability” that should be brought into being “by any means necessary.”

But the “reconquista” won’t end with territorial occupation and secession. The final plan for the La Raza movement includes the ethnic cleansing of Americans of European, African, and Asian descent out of “Aztlan.”

Miguel Perez, a La Raza spokesman at Cal State-Northridge, says, “The ultimate ideology is the liberation of Aztlan. Communism would be closest [to it]. Once Aztlan is established, ethnic cleansing would commence: Non-Chicanos would have to be expelled — opposition groups would be quashed because you have to keep power.”

And so, our new Supreme Court appointee and self-professed advocate of La Raza approves of the reformation of the United States, the creation of a separate Chicano country, and widespread ethnic cleansing. Other La Raza supporters who have appeared at Aztlan gatherings include George W. Bush, John (Juan) McCain, and Barack barrio-loving Obama.

The plans of La Raza and the Aztlan Movement may not raise conservative eyebrows, let alone Christian opposition to Sotomayor’s ascendancy to the Supreme Court, save for the fact that La Raza and other Latino activist groups have expressed widespread anti-Jewish sentiments and support for radical Islam.

This finding is supported by articles in “The Voice of Aztlan” with such lurid titles as “That Shitty Little Country Israel,” “Pat Tillman Got What Was coming to Him,” and “Osama bin Laden: the ‘Pancho Villa’ of Islam.”

If you cannot attend, the Farce of July, it’s high time for you to encounter the Aztlan Underground and to savor the lyrics of their smash hit – “Decolonize:”
